全面推进依法治国视阈下地方治理行政化向地方治理法治化转变的策略选择

On the Strategic Selection of the Local Governance'Transformation from Administration to Legalization in the View of Rule by Law

十八届三中、四中全会的召开,深化行政体制改革已经进入一个新的历程,这就要求各级政府严格按照法治要求办事。在地方治理过程中,政府作为其中的重要主体之一,其治理的法治化程度在很大程度上关系到我国行政体制改革的深度,也事关我国依法治国能否全面推进,据此,我们以全面推进依法治国作为视角,对地方治理行政化向法治化的转变做了简单的论述,并对转变策略做了简单思考。

With the opening up of the Third and Fourth Plenary of the Eighteenth Session, the re- form of the administrative system has come into a new phrase, which demands all levels of govern- ment to rule by law. The government is the main participant in the process of local administration; therefore, its administrative legalization is largely related to the depth of the administrative reform and the comprehensive promotion of rule by law. Thus, this paper, from the aspect of rule by law, briefly analyzes the local governance＇ transformation from administration to legalization and conducts some illustration of the transformative strategy.
