Challenges and Corresponding Strategies for the Privacy Protection in the Big Data Era

网络和计算机技术的发展,使人类进入大数据时代。大数据虽然能够创造较大的经济价值和社会价值,大数据也增加了隐私被侵犯的风险,对隐私权保护带来新的挑战。大数据使保护隐私权的基本原则功能弱化或无效,颠覆着隐私权保护的理念和模式。为此需要将隐私权保护的重心由个人许可转向要求数据控制者承担更多责任,并赋予个人新的权利以及采取完善隐私权救济机制等策略。

People have entered the Big Data Era with the development of network and computer technology. While creating great economic and social value,the Big Data Era has increased the risk in privacy violation,which brings new challenges to privacy protection. The Big Data makes the function of privacy principles weaken or invalid,which overturns the idea and mode of privacy protection. That requires for a shift of the focus of privacy protection from personal permission to data controllers taking more responsibilities. In addition,more measures should be taken,like giving individuals new rights,and improving relief mechanism of privacy protection.
