流浪动物伤人事件时有发生,虽然《侵权责任法》第82条对此做了规定,但该法律条文缺乏可操作性,实践当中很难有效地保护被侵权人的合法权益。围绕该问题,文章对流浪动物损害责任的承担主体展开了论述。

Incidents wounded by stray animals often occurred. Although Article82 of the ＂Tort Law＂ has provisions on this, the law lacks maneuverability that it is difficult to effectively protect the legitimate rights and interests of the infringer in practice. Around this problem, the article discussed the subject to bear the damage liability of stray animals.
