民间法运用于公安执法的价值分析

Analysis of the value of Folk Law applied to public security law enforcement

进入90年代以来,法学界极为关注国家法之外的民间法的研究。但研究方向大多指向私法、司法领域,对民间法在公法领域中的影响和对行政执法的价值并没有给予足够关注,而在整个国家行政执法体系中,公安执法又是最为典型、最为特殊的一种。因此,文章以公安执法为角度,通过分析民间法运用于公安执法的价值,拓充民间法在公法领域的研究。

Since the 1990 s,legal science paid close attention to the Folk Law outsides the National Law. But the researches most focus on the private law field and the judicial field, less on the public law field and the public security law enforcement, though the public security law enforcement is the most typical and special one in the whole country administrative law enforcement system. So in this paper, from the angle of public security law enforcement, analyzing the value of the using of Folk Law in the public security law enforcement, in order to expand the research in the judicial field.
