完善我国打击恐怖主义立法的思考

Reflection on Perfecting Our Country's Legislation to Combat Terrorism

我国目前的反恐形势比较严峻,境内的暴力恐怖主义呈升级之势,给国家和人民生命、财产造成了巨大损失,严重威胁了国家安全和社会稳定。但我国目前关于打击恐怖主义的立法分散、琐碎,相关的反恐条款散见于各部门法中,无法对暴力恐怖主义以坚决、有效的打击,难以形成完善统一的反恐法律体系。因此,我国应加紧制定、尽快出台反恐法,以做到有效预防、依法反恐,推进国家反恐能力现代化。另外,在打击恐怖主义的同时,要充分保障公民的基本权利,不能顾此失彼。

The current situation of anti-terrorism in China has been quite grim ： The terrorist violence is escalating in China＇ s vast territory, has caused great losses to the state, people＇ s lives and property and has seriously threatened the national security and social stability. However, China＇ s current legislation to combat terrorism is not interrelated but separating, and the relevant anti-terrorism legislative provisions are formulated dividedly among individual governmental organs, which can neither be carried out firmly and effectively to strike the terrorists, nor form into a perfect and unified ante-terrorism legal system. So our country ought to establish an anti-terrorism law urgently to prevent and fight against terrorism efficiently and legally and modernize the nation＇ s capabilities to wipe out terrorism. What is more is that while striking the terrorism, the fundamental rights of the citizens must be fully ensured without concentrating on this and neglecting the other.
