模拟法庭常规化教学思路的探索

摘要 模拟法庭教学法是法学教育中一种理论与实践相结合的教学方法或者教学模式,其作为一种直观、生动的实践教学方法备受推崇。模拟法庭教学理念的方向应是将其纳入法学本科生的常规化教学体系当中。因为:模拟法庭教学是法科生实践教学的一种重要形式;模拟法庭教学的深度内涵在于培养大学生的人文精神;现阶段模拟法庭教学中还存在许多弊端,不能真正实现模拟法庭教学的目的。将模拟法庭纳入常规化教学体系,建立一种规范化的模拟法庭教学体系,需重点关注模拟法庭教学目标、模拟法庭教学时间的安排、模拟法庭教学中教师与学生的定位及模拟法庭教学方法等几个关键问题。将模拟法庭教学纳入常规化教学体系对于法科生培养目标的实现意义重大,不仅能调动学生的学习兴趣,而且有助于改革教师的教学方法,总体提升法学的教学实效性。 The teaching method with moot court is a kind of teaching mode in law education, which combines theory and practice. The method has been praised highly as an intuitive and vivid practical one. The direction of the moot court teaching concept should be included in the normalized teaching of law under graduate teaching system because of three factors. Firstly, moot court teaching is an important practical part of law teaching.Secondly, the deep connotation of moot court teaching is to cultivate students' humane spirit. And thirdly, at present there exist many drawbacks in moot court teaching which cannot achieve the purpose of moot court teaching.In order to establish a standardized moot court teaching system, moot court routine teaching should be concerned with the moot court teaching goal, time arrangement, the relationship between teachers and students, and moot court teaching methods, etc. The moot court teaching into the normalized teaching system is of great significance to achieve the goal of training. It can arouse students' interest in learning and is helpful to reform the teachers' teaching methods, and to advance the actual effect of law teaching as a whole.
