Six Important Traditions in Chinese Legal Culture and Spirit

法律文化是地域性、民族性的知识和经验组成的体系。当今我国社会主义法治国家建设应当从古代法律传统中汲取营养。中华法律文化成果中有六个传统和精神值得总结和借鉴:一是国家政体上的共和传统,二是国家管理上的贤哲传统,三是"法治"与"德治"相结合的吏治传统,四是司法上忠于法律的"劲士"传统,五是注重法律实践经验总结和研究的法学传统,六是法律样式上的"混合法"传统。

Legal culture is a system composed of knowledge and experience with regional and national characteristics. Now, China should learn from the ancient legal traditions to develop a socialist country under the rule of law. There are six traditions and spirits in the Chinese legal culture that are worth reviewing and learning. first, the republic tradition in terms of the system of government; second, the sages tradition in terms of the national governance; third, the tradition of using both the rule of law and the rule of virtue in terms of officials management; fourth, the ＂upright man＂ tradition in terms of loyalty to the law; fifth, the legal study tradition that values reviewing and researching law practices and experience; and sixth, the ＂hybrid law＂ tradition in terms of the forms of law.
