摘要
阐释了"涨价归公"的理论内涵,从外部性的角度说明"涨价归公"可以实现社会利益的最大化。通过借鉴台湾对"涨价归公"理论的实践模式及经验——市地重划和区段征收,结合大陆的产权制度、传统的征地补偿经验,探讨"涨价归公"理论如何指导大陆征地过程中土地增值收益的分配,从而改善现行的征地补偿制度。
This paper elaborates the theory of"public Appreciation",and demonstrates that the practice of"Public Appreciation"can maximize the social benefit from the perspective of externality.Then,this paper thoroughly studies the practical experience of"public Appreciation"——urban land consolidation and zonal expropriation in Taiwan.From the enlightenment of the theory of"public appreciation"and Taiwan's successful practices,the paper examines the existing land expropriation compensation mode in China's Mainland,and attempts to modify it by distributing land value increment raised by land expropriation and development under the principle of public appreciation.
