口述档案的著作权保护:基于英美口述史法律伦理指南的分析

本文通过对英美口述历史协会制定的涉及口述历史与口述档案著作权保护的两项指南进行分析,从法律与伦理的视角考察了英美在口述档案采集、整理、保管与提供利用等环节中保护著作权的具体做法并归纳其特点,最后提出英美口述档案著作权保护对我国的启示。

Through analyzing of two pieces of guidelines which relates to the copyright protection of oral history and oral archives, formulated by Anglo American Oral History Association. From the perspective of law and ethics, this paper analyzes the specific practices of the copyright protection from the acquisition, arrangement, preservation and utilization of oral archives, and sums up its characteristics. At last, the author puts forward the British and American copyright protection of oral archives in the enlightenment to our country.
