关于民法典总则立法的几点思考

On the Legislation of the General Provisions of the Civil Code

我国民法典的编纂应当采取分步走的方式,首先进行民法典总则立法。民法典总则立法不能采取修改补充《民法通则》的方式进行,应当重新立法,也不能以制定民法典通则代替民法典总则。民法典总则的体例设计应当采取总则加实质序编的"大总则"模式,不能以序编代替总则,其逻辑构造应当以权利为主线。

The compilation of civil code of China should take step by step way, first carry on the legislation of the General Provi- sions of the Civil Code. The legislation cannot take the way only to modify and renew the ＂General Principles of Civil Law＂ , but should formulate a new legislation, and should not use the general principles of civil code to replace the general provisions of civil code. The system of the general provisions of civil code should adapt the model that includes a substantial preface, which may be called ＂A Big General＂. The main logic line of the general provisions of civil code should be ＂the right＂, but not the others.
