江苏省预防未成年人犯罪地方立法的实证分析——以A市未成年人犯罪成因和预防现状为调研对象

The Empirical Analysis of Local Legislation of Prevention of Juvenile Crimes in Jiangsu Province

出于为江苏省预防未成年人犯罪立法提供实证依据的研究需要,对具有典型代表意义的A市未成年人犯罪预防进行了基础性数据调查、典型案例采样和重点访谈调研,通过归纳总结相关经验可以发现:制定江苏省预防未成年人犯罪地方立法是推进未成年人犯罪预防工作朝向职权整合化、职责明晰化和经验制度化方向发展的紧迫性和必然性需求。调研表明江苏省未成年人犯罪具备独特的家庭原因、媒介原因和社会原因,在特殊预防层面也存在着学校教育保护不足、社会力量难以配合、社区矫正局限和社区综合预防羸弱等突出问题。在这些问题基础上吸收地方预防经验,可以更为清晰地从江苏省实际情况出发制定符合实际需要的系统性预防立法,以最大程度促进预防未成年人犯罪工作的效率和效益,整合各方力量形成科学有效的针对性预防体系。

For the purpose of research on providing empirical basis for local legislation of prevention of juvenile crimes ,fundamen- tal date survey, collection of typical cases and intensive interviews and research on juvenile crimes of representative city A have been pursued. And we can conclude by summarize the experience： It is an urgent and necessary need to make a legislation on prevention of juvenile crimes for carrying prevention of juvenile crimes forward to integration of authority, clarification of duty and institutionalization of experience. The research indicates that the juvenile crimes of Jiangsu Province have the unique reasons of family, media and society, and the outstanding problems of lack of protection of schools, difficulties on society, limitation of community corrections and weakness of compositive prevention of community on the level of special prevention. On the basis of those problems, we can learn the experience of other local legislation and make a preventive and systematical legislation in the light of the practical need of the actual situation of Jiangsu province , to promote maximum the efficiency and benefit of the work of prevention of juvenile crimes and form the scientific and effective system of prevention by integrating all kinds of parties.
