近代中国新闻立法规制“媒体审判”的历史析论

An Analysis of History of Modern China's News Law Regulating “Trial by Media”

中国近代新闻立法思想谱系的构建,推动了新闻法律体系形成的整体进程,但近代媒体报道司法的权限、法律责任、大量"报刊案"等问题体现媒体与司法关系未能和谐发展,制度异化成为左右两者关系的重要因素。近代中国新闻立法凸显了司法与媒体关系异化的严重程度,制度变革成为近现代司法与媒体关系和谐构建中的重要问题。本文基于对近代中国新闻立法对"媒体审判"规制的历史探析,认为当前应继续放开媒体对司法问题的舆论监督,对媒体的约束不应仅仅体现在立法上,更重要的是"法治化"管理上。

The construction of modern Chinese news legislation thought pedigree promoted the whole process of news law system,but the problem in modern media reporting judicial authority,legal responsibility,a large number of＂news paper＂cases reflecting the disharmonious development of the relationship between the media and the judiciary,systematic alienation became the important factor which affecting the relationship between the two. Modern journalism legislation highlights the severity of judicature and media relations alienation,institutional reform has become an important problem of modern judicature and media in the construction of harmonious relationship. From the analysis of modern China＇s news legislation regulating ＂trial by media＂,we should continue to release the freedom of opinion in media about the judicial problems. The media constraints should not be only reflected in the ＂legal＂way,more important is the ＂rule of law＂management.
