我国政府法律顾问制度的实践与完善

政府法律顾问制度起源于西方,它对于建设法治政府、优化社会治理具有非常重要的作用。我国自上世纪八十年代开始推行该制度,虽然取得了一定的成效,积累了一定的经验,但也暴露出各地发展不均衡、运行机制不健全、参与力度不够、独立性不强等问题。为了进一步健全该制度,实现政府法律顾问工作的规范化、常态化,国家应明确政府法律顾问的性质和地位,规范政府法律顾问工作的原则与范围,理顺政府法律顾问的管理机制,完善政府法律顾问工作的保障体系。

The system of government legal adviser originated in the west, wmcn plays a very important role in construction of Law-based Government and optimizing the social governance. China began to implement the system since the eighty＇ s of last century , which has made some achievements, but there are also uneven development, imperfect operation mechanism, inadequate participation, not strong independence and other issues. In order to further improve the system and achieve the standardization and normalization of the work of the government legal adviser, the state should define the nature and status of the government legal adviser, specify the principles and scope of work of the government legal adviser, streamline the management of government legal adviser and improve the security system of work of government legal adviser.
