集体下跪:非常态公民参与的法学反思

Collective Kneeling Down:Reflection of Abnormal Civic Participation in Legal Science

近年来,全国各地出现了以集体下跪这一非常态形式的公民参与现象。由于集体下跪能给政府造成巨大的舆论压力、维稳压力和执政合法性压力,因此下跪者是以牺牲尊严的方式来换取问题的可能解决。集体下跪式参与是时代的悲哀,是各种利益冲突不断演化与公民维权参与渠道不畅的综合结果。本文从法学视角反思了集体下跪发生的原因,提出应落实和维护公民参与权,用法治手段保障公民的有序政治参与。

In recent years,an abnormal civic participation of collective kneeling down has occurred in many places domestically.Since collective kneeling down makes the government be exposed to huge pressure from public opinion,pressure of stability safeguarding and pressure of ruling legality,therefore,the kneelers sacrifice their dignity to get the problems solved.The participation of collective kneeling down is the woe of this era,and it is an integrated result of increasing evolution and development of various interest conflicts as well as the citizen＇s unsmooth participation channel for safeguarding their legal rights.This paper reflects the reasons for collective kneeling down from the perspective of legal science,and proposes the solving countermeasures：implementing and safeguarding the constitutional right of citizens＇ participation rights,so as to guarantee the citizens＇ ordered political participation by legal means.
