尼泊尔某水电站工程总承包合同管理实践与探索

Practice and Exploration of EPC Contract Management

尼泊尔某水电站是中国进出口银行对尼泊尔提供的第一个优惠贷款项目,也是尼泊尔政府第一个水电工程总承包(EPC)项目。虽然合同采用了国际通用的FIDIC银皮书,但在雇主要求中直接套用了以往已实施项目的合同文件。EPC合同具有一定的特殊性,致使工程总承包施工合同中部分内容与FIDIC银皮书的精神存在矛盾。通过对该水电站合同管理实践与探索,提出了一些对特殊合同问题的处理方式及实践经验,取得了较好的效果。

One hydropower project in Nepal is the first one with the preferential loan from EXIM bank of China. It is also the first one which is built by the government of Nepal in EPC mode. Although the EPC contract is prepared based on FIDIC,the Client directly copies the contract of the projects previously implemented in the Client＇s requirements,resulting in conflicts between the EPC contract and FIDIC terms.Through the engineering practice and exploration of the contract management of the hydropower project,handling modes and practice experience on the special contract issues are provided in the paper.
