摘要
海运履约方制度是《鹿特丹规则》针对门到门运输的海运实践的一次创新,该制度突破传统理论限制,极大地发展了合同相对性和连带责任理论。该制度引起国内外实务界和理论界的关注。对中国来说,该制度为中国解决港口经营人责任问题,为港口立法提供了一个新视角。但是,中国立法也不能简单地引进该制度,只能在研究其内涵的基础上,将该制度的精髓贯彻到未来立法当中。
Maritime performing party system represents an innovation in the shipping practice on the basis of door to door maritime transportation. The system breaks through the limit of the traditional theory and greatly develops the contract relativity and the theory of joint and several liability, arousing high attention of the theory and practice field at home and abroad. In the case of China, the system presents a new perspective for approaching Chinese port operator liability and port legislation. However, Chinese legislation does not simply call for introduction of the system but carries the system's essence through the future legislation on the basis of its connotations.
