论土地承包经营权流转视野下的农民权益保障

Farmers' Rights and Interests Protection from the Circulation Perspective of Land Contract Management Right

保障农民权益是农村一切工作的出发点和落脚点,目前,农村土地承包权流转具有农民流转意愿增强、流转行为日趋规范、规模经营效益明显,功能显著等特点,但仍然存在土地物权主体不明、土地收益受损、社会保障缺失以及农民自身权益意识不强等诸多问题。鉴此,要明确土地物权主体、保障农民程序性和实体性权益、加强农民后续生活保障工作、强化农民权益意识,最终实现对农民权益的有效保障。

Protecting rights and interests of farmers is the starting as well as ending point of all the work in the countryside. At present,the circulation of land contract management right strengthens the circulation of farmers＇ willingness,standardizes the behavior of circulation increasingly,expands the benefits scale of business obviously,and functions remarkably. However,some problems still exist as follows： the owner of the land is not clear; the benefit of the land is damaging; the social protection is deficiency and the farmers＇ awareness of protecting their rights and interests is weak. In view of this,we should make clear of the owner of the land,protect the procedural,substantive rights and interests of farmers,and strengthen the support of farmers＇ subsequent life and their awareness of rights and interests,which can ultimately realize the effective protection of farmers＇ rights and interests.
