概率统计在施工合同双方地震风险责任分配中的应用

摘要 在建筑工程施工过程之中,各种风险随时会产生,且风险一旦出现就会影响工程的工期和成本。不可抗力作为一种对建筑工程影响非常大的风险,引起了业主和承包商的重视。业主和承包商在签订合同的时候,应该遵循公平公正的原则,明确双方应该承担的风险责任,避免风险发生后引起纠纷。地震风险作为不可抗力中的一种,是施工过程中常见的风险。依据概率统计的原理,结合小概率事件,划分合同双方的地震风险责任,为业主和承包商提供参考依据,做好风险应对措施,保证工程的顺利完成。 When engineering construction begins, the risk follows, which will affect the construction period and cost of the item once it happens. Force majeure causes the attentions of the owner and the contractor as a very big risk for the engineering construction. When the owner and the contractor conclude a contract, they should comply with the tenet of equity, clear the risk sharing of the both parties, avoid entanglement caused by divergence. As one of the force majeure, the earthquake risk is prevalent during the construction. Based on the method of probability and statistics, synthesize minor probability event, divided the contract both sides of the seismic risk responsibility, provide a referenced basis for the owners and contractors, do risk measures, make the project fulfill smoothly.
