强迫妇女穿遮面服饰行为的刑事立法规制

On the Criminal Law Regulation about the Conduct of Forcing Women Wearing Face-covered Garments

遮面服饰是一种具有宗教极端思想色彩的宗教服饰。强迫妇女穿着遮面服饰不仅侵犯公民宗教信仰自由权利,而且还传播宗教极端思想,威胁社会稳定,具有严重社会危害性。我国《刑法》规定的非法剥夺公民宗教信仰自由罪和寻衅滋事罪均不能对此种行为予以有效打击。立法机关应借鉴法国《禁止在公共场所穿着遮面服饰法案》的规定,修改刑事立法以有效打击此种行为。

Face-covered garments is a kind of Religious clothing with Religious extremist ideas.The conduct of forcing people wearing face-covered garments infringes citizens＇ freedom of religion belief,threatens social stability,with severe social harmfulness.The crime of unlawful deprivation of citizens＇ freedom of religious belief has shortages on combating this conduct as well as the crime of picking quarrels and provoking troubles.The legislature should draw on the experience of the law baning the conduct of wearing face-covered garments in public places in France,amending the criminal law against this conduct.
