Benefit Sharing Mechanism of the Subjects of Intellectual Property of Intangible Cultural Heritages

千百年来,华夏各族人民创造了极其丰富的非物质文化遗产,这些珍贵的非物质文化遗产是各民族历代人民集体智慧的结晶,是人类共同的精神财富。实现非物质文化遗产"真实性、整体性和传承性"保护目标,必须切实尊重并保障非遗知识产权主体权利,构建科学、规范、理性的利益分享机制,从健全国内法制、明确主体责任及权利、发挥传承人引领作用、实现代际公平等措施入手,做到科学保护与可持续利用的一致性,遵循文化遗产保护规律,为弘扬民族文化、增进民族认同、促进民族和谐发展奠定文化基础。

Over thousands of years, the Chinese people of all ethnic groups have created abundant intangible cultural heritages which are the crystallization of collective wisdom of ethnic groups of all generations and the spiritual wealth of all human beings. In order to realize the protection objective of ＂ authenticity, integrity and inheritance＂, the intellectual property of the subjects of these heritages should be respected and protected, and a scientific, standard and rational interest sharing mechanism should be constructed. Through methods of seeking reasonable rules of international conduct, perfecting domestic legal system, making clear the responsibility and legal interests of the subjects, encouraging community participation, giving the leading role to inheritors and realizing intergenerational equity, we should maintain the consistency of scientific protection and sustainable utilization, follow the rules of cultural heritage protection, and lay a cultural foundation for developing national culture, promoting national identity and enhancing harmonious national development.
