农村土地承包经营权信托的实践模式与制度设计

Practice Model and Institutional Design of Rural Land Contractual Management Right Trust

土地承包经营权信托是土地承包经营权流转方式的重要创新。实践中,我国已经出现浙江"绍兴模式"、湖南"草尾模式"及安徽"宿州模式"等典型模式。我国应依据《农村土地承包法》、《物权法》、《信托法》等法律法规,并总结土地承包经营权信托的实践经验,构建农村土地承包经营权信托的法律制度。立法上应明确土地承包经营权信托的客体为土地承包经营权,健全信托委托人、受托人、受益人的权利赋予与义务负担,平衡各方主体的利益关系。通过土地承包经营权信托的设立与生效、登记公示、变更和终止等运行机制的设计,为土地承包经营权信托发展提供法律保障。

Land contractual management rights trust is an important innovation of land contractual management right Transfection. In practice,there has emerged the ＂Shaoxing mode ＂in Zhejiang,the ＂Caowei Mode＂in Hunan,＂Suzhou Mode＂in Anhui and other typical modes in China. Experience should be summed up in strict accordance with the Rural Land Contract Law,Property Law,Trust Law and other laws and regulations so that a legal system of land contractual management right trust can be established.The system is expected to specify that the object of the trust is land contractual management right,and improve and balance the rights and obligations of all parties concerned.With the design of the establishment,registration publicity,changes and termination of the trust,it is to provide legal protection for the development of land contractual management rights trust.
