摘要
在页岩气发展过程中,法律确认不可或缺。我国页岩气法律制度的构建具有政策、法律优势,同时也是经济发展与环境保护的必然路径。在构建页岩气法律制度过程中,我国需要重塑环境影响评价制度,构建排污权交易制度,强化公众参与机制,同时严格法律责任,确保页岩气发展的持续性、稳定性与确定性。
Energy can not only express human＇s simple consumption emotion, but also show human＇s loyal consumption belief. Now the shale gas, of both energy and environment values, has become the best choice for the contemporary people since the existing energy resources are too insufficient to meet human＇s demands. However, the development of shale gas is inseparable from the legal recognition. China＇s legal system of shale gas has advantages in law, which is also a necessary path of economic growth and environmental protection. In order to build and improve the legal system of shale gas, great stress should be put in reshaping the environmental impact assessment system, structuring the emission trading system and strengthening the public participation system. Meanwhile, it is necessary to specify the legal duty, thus to keep the consecutiveness, stability and certainty of shale gas development.
