摘要
涉诉信访的四种基本类型是谋利型上访、维权型上访、无理型上访和说理型上访。当事人采取的涉诉信访策略包括越级访、倒逼策略、闹访和缠访等等。法院治理涉诉信访的策略有:做思想工作、发放司法救助金、包案责任制、源头治理等等。信访嵌入审判结构具有双重作用:一方面,赋予当事人进入维稳系统进行博弈的权利;另一方面,成为诉讼程序无限延伸的制度通道。由此,基层法院出现"息诉"和"歇访"的辩证律,即所采取的一系列"息访"手段都只能起到暂时的"歇访"作用,而不能彻底化解矛盾。
There are mainly four types of the Litigation Involved Complaint Letters and Visits: inter- ests-seeking petition, safeguard rights petition, unreasonable petition and reasoning petition. Litigation petition strategy adopted by the parties including leapfrog visit, forced strategy, noisy and wrapped visits and so on. The governance strategies of court have ideological work, judicial assistance payments, accountability package case, source control and so on. The petition embedded the trial structure has a dual role: on one hand, it endows the party rights entering the system stability; on the other hand, it becomes the chan- nel of the infinite extend of the lawsuit procedure. Thus, the grassroots court have the dialectical rate of "break with the petition" and "rest the petition", that is a series means of the "break with the petition" can only play a role of "rest the petition", but can not completely resolve the contradictions
