美国负面清单的内容、形式及其借鉴意义——基于47个美国BIT的研究

The Contents and Forms of U.S. Negative List and Its Reference Based on the 47 U.S. BITs

中国(上海)自由贸易试验区开启了中国的"负面清单时代",对中国对外开放层次的提高具有重要意义。新的投资管理模式对中国政府也提出了重大挑战,充分借鉴和吸收发达国家在这方面的经验至关重要。在这样的背景下,文章对美国已签署的47个双边投资协议(BIT)中的负面清单进行了全面梳理,对负面清单所涉及的项目进行了分类和归纳,刻画和分析了美国BIT中负面清单制度的发展和演变,并探讨了其对中国的借鉴意义。

China （Shanghai） Free Trade Area starts the ＂Negative List Era＂ of China. It has significant meanings to China＇s opening up strategy. Meanwhile, it is also a big challenge to Chinese government, thus it＇s important to learn from the experiences of the developed countries. This paper analyses the contents in the negative lists of 47 U.S. BITs, describes the development and evolution of the U.S. negative list management mode, and explores its reference meanings to China.
