集体建设用地流转实践的问题与对策探析——以珠三角地区为例

摘要 在当前的土地制度改革的大背景下,为重新审视现有制度的缺陷,为国内其他地区提供有益参考,对2005年以来广东省尤其是珠三角地区的集体建设用地使用权流转的实践及问题进行了研究。研究表明,当前集体建设用地流转还存在诸多问题亟需解决,包括缺乏上位法的支撑、流转主体相对复杂、程序有缺陷、配套政策不完善、监管仍显混乱、思想认识上不到位等。针对以上问题,提出了深化征地制度改革、加快上位法修改、进一步完善配套政策和规定、加强流转的监管、加强宣传引导等方面的对策建议。 Under the current background of land system reform, in order to re-examine the defects of current system and provide helpful reference for other regions, an analysis was taken base on the Practice of Collective Construction Land Transference in Guangdong Province especially in Pearl River Delta Area since2005. The results show that there are still many problems of current system of collective construction land transferences to be resolved, such as lack of support of laws, complicated subjects of transferences, defects of procedure, the imperfect supporting policies,confusion of supervision, and the ideological understanding is far from perfect. Then the paper put forward some countermeasures and suggestions about deepening reform of land expropriation system, to accelerate modification of related laws, to further perfect supporting policies, to strengthen supervision and publicity and guidance.
