水库移民征地补偿长效模式的法制规范与制度构建

Legal System Perfection and Institutional Amelioration on the Long-term Compensation for Reservoir Resettlement

研究目的:反思和完善中国水库移民征地补偿长效机制。研究方法:社会实证分析和规范分析相结合。研究结果:长期以来,虽然中国对水库移民征地补偿长效模式开展了多种形式的探索,但囿于法理认知的浅薄以及法律制度的不足,长效补偿呈现出无序发展的态势。为了实现水库移民补偿安置"发展、共享"的人权价值,迫切需要从法律上明晰长效补偿的权利义务关系,完善其运行架构和机制。研究结论:对水库移民实施长效补偿是回应开发性移民的时代要求。

The purpose of the paper is to reflect and perfect the long-term compensation system for reservoir resettlement in China. Methods employed are the combination of empirical and normative analysis. The result indicates that it is necessary to develop the long-term compensation for reservoir resettlement. Although China has carried out various forms of exploration on reservoir resettlement compensation for long-term models, long-term compensation system currently is generally in disorder situation because of the defects of the relevant legal system. In order to realize the human rights value of ＂development and sharing＂ of the reservoir resettlement compensation, it is urgent to clear the legal relation of long-term compensation and to improve the operational structure and mechanism.
