工程建设标准标志的知识产权保护

About the IPR for Engineering Construction Standard Marks

工程建设标准标志伴随建设标准而生,既能对工程建设标准的使用起到指示作用,并进一步对工程建设产品品质起到区分和鉴别的作用。因而,工程建设标准标志的知识产权应得到保护,同时也应兼得商标权的保护。由于某些标志属于国家强制标准标志,某些标志是由标准标志衍生而来,也能对标准的使用起到区分和鉴定作用,因而具有一定的商业价值。如何保护工程建设标准标志的知识产权,既不违背标准制订的本意,还能通过标志的使用,推动标准被广泛使用,既是一个标准化的发展趋势,也是知识产权领域的一个新兴课题。本文尝试从工程建设标准标志的发展和功能出发,从理论和实践两方面,探讨工程建设标准标志的知识产权的属性及保护。

Engineering construction standard mark was born accompanied by the standard of engineering construction standard, not only can be used as indication of engineering construction standard, and can be used to distinguish the quality of construction product further. Therefore, the Intellectual property of engineering construction standard mark should be protected, at the same time, the trademark right should be protected also. Because some marks belong to the national compulsory standard, some others were derived from the standard mark have distinction and appraisal function thus contain some commercial value. How to protect the trademark right of engineering construction standard mark on a basis of neither against the original intention of standard but to promote standard＇ s widely use are the developing trend of standard and also a new subject in the field of intellectual property. This paper try to discussing the attribute and the Intellectual property right protection of engineering construction standard mark from two aspects of theory and practice.
