摘要
委托运输管理已成为当前合资铁路运输管理的普遍模式,在整个委托运输管理模式中,法律责任的承担成为托管双方最为关注的问题之一。分析铁路委托运输管理模式的现状及优势,以委托运输管理状态下铁路交通事故为视角,对涉及的民事、行政及刑事法律责任分别进行研究,得出铁路委托运输管理托管双方各自应承担的法律责任结论。
Entrusting transportation management has been a kind of normal mode for joint venture railway transportation management.In this process,legal liability becomes one of the most concerned problems.This paper analyzes the situation and advantages of entrusting railway transportation management,takes railway traffic accidents under the state of entrusting transportation management as an example,studies the involved legal liability,comes to the conclusion that client and trustee are both liable.
