澳门海域管辖权取得的意义及其途径研究

Discussion On the Way to Secure Jurisdiction over The Sea Area of Macao

取得海域管辖权是澳门海域使用管理的逻辑起点。现阶段,澳门取得海域管辖权有两种途径:一种是通过调整或确认海域行政区划的方式取得,另一种是通过"租用"一定范围的海域并取得中央特别授权的方式取得。上述两种方式各有利弊,但考虑到澳门的现状和未来发展趋势、取得方式本身的经济成本和取得海域资源作用的发挥等因素,澳门应积极争取通过调整或确认海域行政区划的方式取得海域管辖权。

To secure jurisdiction over the sea area adjacent to Macao is the logical starting point of the use and management of sea areas.At present,there are two ways to secure the jurisdiction.One is made by adjusting or confirming the sea area administrative division between Zhuhai and Macao;the other one is made through authorization of central authority on the base of Macao’s renting a certain scope of sea area.The above two ways each have their advantages and disadvantages,but considering the present situation and the future development trend,the economic cost and the value of the sea area obtained-to-be,Macao should strive for it by the first way.
