中国农村宅基地使用权流转机制研究

Circulation Mechanism Design for the Right of Rural Residential Land

长期以来宅基地问题一直是中国农村工作的热点话题,探索农村宅基地使用权流转机制对中国农村发展具有积极的意义。目前学术界对是否允许宅基地流转存在三种观点:禁止流转论、限制流转论和自由流转论。中国对宅基地流转也进行了积极的实践探索,出现了天津宅基地换房、成都温江双放弃、重庆地票交易等极具借鉴意义的流转模式。当前中国农民增收、新型城镇化进程和高房价等原因决定农村宅基地流转是必要的,有效的宅基地流转机制设计是必须的。

For a long time, the issue of rural residential land has been a hot topic for Chinese rural work. Therefore, exploring the circulation mechanism has a positive significance for rural development in China. there are three academic perspectives on whether to allow the circulation of the current residential land： ban on the circulation, restrictions on it and the free theory of it. China has been actively exploring the residential land, and then there have been some circulation modes which can be regarded as references： house-exchange in Tianjin, double abandonment on Chengdu and Wenjiang, and land transactions in Chongqing. The circulation of rural land is necessary and the effective mechanism design is a must due to the increasing income of farmers, the process of new urbanization.
