摘要
本文就"大部制"改革后,食品安全监管与我国现行食品安全法律存在不相适应的问题进行分析,提出强化食品安全监管的几点思考:一是转变食品安全监管法制理念,增设"分产品品种管理"的监管职责;二是修改现行法律及行政法规中监管主体不适格的问题,明确"大部制"改革后食品安全监管部门的法律主体地位;三是通过依法执法、联合执法、委托执法等临时对策解决"大部制"改革后的法律困境。
This paper analyzes some problems of the current food safety law in China after the super- ministry system reform, and it provides some thoughts about how to reinforce the food safety supervision and management as follow: First, changing the legal concepts of food safety supervision and management, and adding the supervising responsibility of "classifying the products"; Second, revising some improper laws or administrative regulations of food safety supervision and management, and clearing the legal subject; Third, Solving the problems left by the super-ministry system reform with the ways of enforcing by law, joint enforcement, and entrusted enforcement.
