Truthfulness of Justice and Legal Translation——A Probe of Habermas' s Justice View

当代多元社会由于系统(权力和货币)对日常生活世界的凌侵,造成交往及其话语扭曲,使政治合法性和社会秩序面临失范,哈贝马斯提出了一套完备的正义共识理论以建构公正的社会秩序。他也看到传统的正义观具有道德不确定性的缺点,因此他把正义共识转译为合法性问题,即通过商谈民主和程序性的法制来保证公正社会秩序的实现。

In the present pluralistic society, the common living world is invaded by power and currency system,resulting in the distortion of communication and utterance, and anomie of political legitimacy and social order.Habermas put forward a complete justice concensus theory in the hope of establishing fair and square social order.He noticed that traditional justice view was probabilistic, and so he translated justice concensus to legitimate issue,that is, to guarantee the realization of fair social order via discussion of democratic and procedural legal institution.
