西地那非的中国专利保护现状分析

Analysis of patent protection situation of sildenafil in China

本文研究西地那非在中国的专利保护现状,为医药企业进行药品仿制和制定专利保护策略提供参考。在STN和CPRS数据库中检索涉及西地那非的中国专利申请,使用中国专利分析系统并结合手工标引和筛选分析所得数据。分析了西地那非相关的专利申请总体情况、有效专利情况和原研企业的专利保护情况。建议医药企业在仿制前深入了解西地那非的专利保护状态,同时借鉴原研企业的专利布局和保护策略制定合理的仿制、创新策略,以规避侵权风险,加强自主研发,提升自身竞争力。

In this paper,we introduced the patent protection situation of sildenafil in China to give references for generic drug development and patent protection strategy-making of pharmaceutical companies. Chinese patents related to sildenafil were searched from STN and CPRS databases. The obtained data were screened and classified manually,and then analyze by Chinese Patent Analysis System. The overall situations of patent applications,granted patents and valid patents involving sildenafil as well as patents＇ original research company were analyzed. Suggestions for pharmaceutical companies include that the patent protection of sildenafil must be concerned before development of the generic drugs,patent protection strategies can be made by learning from the original research company in order to avoid risk of infringement,and independent RD should be enhance to increase competitiveness.
