我国物流法律制度的发展探析

The Analysis on the Development of China's Logistics Legal System

在全国球经济一体化的推动下,中国大陆物流业飞速发展,但各项物流法律制度仍然滞后,内部缺乏协调统一的立法逻辑的弊端显现,导致物流业企业生存艰难,难以适应现代物流业发展。构建物流法律体系,是我国融入国际物流一体化、发展现代物流业的必然选择。笔者认为,必须充分认识我国物流法律制度的现状的发展,才能逐渐完善我国的物流法律体系。本文对我国物流法律制度进行了理性审视,并给出了我国法律制度体系中存在的问题,预测了物流法律制度今后的发展方向。(注:本文所称"物流法律"是与物流相关的法律法规的总成。)

under the impetus of global economic integration,the logistics industry develops rapidly in China mainland,but its legal system is still not perfect and lack of harmonious and unified legislation logic inside,which makes logistics enterprises hard to adapt to the development of modern logistics industry,causing their survival difficulties.The establishment of the logistics legal system is the inevitable choice for China to integrate into the international logistics and develop modern logistics industry.The author believed that,in order to gradually improve our logistics legal system,we must fully understand the present situation of its development.This thesis made rational inspection on the logistics legal system in China and pointed out the existing problems in it and forecast the future development direction of logistics legal system.（Note：This term ＂logistics law＂is the assembly of logistics-related laws and regulations.）
