技术的每一次进步都将给著作权制度带来新的挑战。云时代的到来,改变了对作品载体进行占有的传统作品体验方式,取而代之的是对作品内容进行直接体验的新型作品体验模式。这无疑使得著作权人赖以维护利益的复制权受到强烈冲击,由此产生的临时复制问题及其所带来的利益冲突在云环境下也越显尖锐。如何通过立法完善云环境下的复制权,使得著作权制度能够追上技术发展的脚步,这个问题值得我们持续关注和探讨。
Every progress of technology will give the copyright system new challenges. In the cloud era, a new and direct copy experience mode has replaced the traditional one. The reproduction right that the copy- right owners safeguard the interests has been strongly impacted. And the problem of benefits in reproduction temporary increasingly sharp in the cloud environment. How to maintain the legislation to improve the reproduction right, which makes the copyright system catch up with the pace of technology development, is worthy of our continued attention and discussion.
