摘要
《自贸区仲裁规则》借鉴吸收了国际上先进的仲裁经验和制度,是我国乃至全世界最先进的仲裁规则。仲裁规则的实施需要国家立法予以支撑,而《自贸区仲裁规则》的先进性使之与国内立法在一些创新性制度上相脱节,引发临时措施强制执行、默示仲裁协议效力、裁决关于第三人的执行等问题。为实现国家设立自由贸易区的目标、形成可复制和推广的经验,就必须克服仲裁规则与现行法律相适应的问题。
The FTZ Arbitration Rules,which have absorbed international advanced experience,has become the most advanced arbitration rules in the world.The implementation of these arbitration rules need the support from the national legislation,but the advanced nature of the FTZ Arbitration Rules has created problems such as the enforcement of interim measures,validity of implied arbitration agreements,the enforcement of the award including the third people,and others.In order to fulfill the goal of setting up the FTZ and forming duplicable experience,we must overcome the current legal problems caused by the advanced FTZ Arbitration Rules.
