摘要
航班延误下旅客非理性维权现象时有发生,屡禁不止,严重影响到航空运行秩序。文章运用博弈的思想和方法,从航班延误下旅客与航空公司间维权博弈的角度入手,分析旅客非理性维权的原因所在,并提出促进旅客理性维权的应对策略:民航主管部门加强对航空公司的监管;公安机关加强对旅客的监管;完善航班延误赔偿法律制度;构建便捷的维权路径。
The phenomena of passenger irrationally claiming rights under flight delay occurs frequently which seriously affects the aviation operation. The article analyses the reasons of passenger irrationally claiming rights from the angle of game, starting from view of the claiming rights game between passengers and airlines under flight delay, and puts forward the coping strategies to promote passenger rationally claiming rights. The civil aviation authorities should strengthen the supervision of airlines, while the public security organs should strengthen the supervision of passengers. The related departments should perfect legal system of flight delay compensation and build the convenient path of claiming rights.
