食品安全惩罚性赔偿制度研究

Study on the System of Punitive Damages in the Field of Food Safety

惩罚性赔偿是打击食品安全违法犯罪行为的重要制度之一。本文比较分析了中美两国食品安全惩罚性赔偿制度,指出了目前我国食品安全惩罚性赔偿制度存在的一些问题,提出了改进我国食品安全惩罚性赔偿制度的相关对策,如修改惩罚性赔偿制度适用条件,修改惩罚性赔偿金额计算方法及食品生产经营者承担举证责任等。

Punitive damage is one of the most important systems of combating illegal acts and crimes in the field of food safety.This paper compares and analyzes the punitive damages systems in the USA and in China,points out some main problems existing in punitive damages system of food safety in China,puts forward some countermeasures to improve punitive damages system of food safety,such as modifying the applicable conditions of punitive damages system,modifying the calculation method of the amount of punitive damages,and food producers and sellers should be bear the burden of proof,etc.
