摘要
近期环境污染事件呈高发之势,众多环境犯罪却主要依靠行政处罚的方式进行规制,环境污染刑事救济机制"名存实亡"。构建以生态法益为核心的刑法理念,发挥刑事司法打击环境犯罪的关键作用成为建设美丽中国,构筑生态文明的时代需求。唯有从立法上设立刑事环境犯罪专章,完善环境刑事司法专业性追责体系,才能更好发挥捍卫生态法益最后一道法律屏障的功能与作用。
The rate of environment pollution events has been on the rise recently.A number of environmental crime has relied mainly regulation by means of administrative penalties,environmental pollution criminal remedies mechanism exists in name on-ly.We should construct the criminal law concept on the core of ecological legal interest and fully utilize the function of criminal justice to combat with environmental crime to building the beautiful China and build era needs for ecological civilization.We could better exert the function of the last legal barrier and roles to protect the ecological legal interest only through setting up a specific law of environmental crime from the legislation and improving the professional responsibility undertaking system of envi-ronment criminal justice.
