我国殡葬行业已经成为了众人皆知的暴利行业,造成这一现状的重要原因之一就是殡葬行业行政性垄断的盛行。行政性垄断的基础是行政权力,相关主体滥用了其行政权力进行垄断行为,继而损害公众利益造成不利的后果。行政性垄断的构成包括主体、行为、后果等方面,针对殡葬行业的垄断现状,必须在限制权力、加强监管、完善立法等方面展开措施,这不仅是为了维护行业经营者的利益,也是为了维护社会公众的利益。

The funeral industry in China has become known as a profiteering industry. One important reasons of this situation is the prevalence of administration monopoly in the funeral in- dustry. Administrative power is the foundation of administrative monopoly. The relevant subjects abuse their administrative power for monopoly behavior, which in turn damages the interests of the public,leading to adverse consequences. Administration monopoly structurally includes sub- ject, act, consequence and other aspects. According to current the situation of monopoly, admin- istrative power must be limited with more intense supervision, and effective legislation, which is for the interest of the business and the public.
