公益性数字图书馆建设中的信息网络传播权授权问题研究

On the Authorization to Right of Communication Through Information Network for Public Digital Library

我国当前的法律对公益性数字图书馆的信息网络传播权授权问题限制过多,削弱了公益性数字图书馆促进信息资源传播的职能。应当对公益性数字图书馆作为特殊主体单独立法,或者采取适当扩大公益性数字图书馆对版权作品"合理使用"的范围、建立公益性数字图书馆的法定许可制度、完善著作权集体管理制度等措施促进公益性数字图书馆的发展。

The current legislation of China excessively restricts the authorization to right of communica- tion through information network for public digital library and weaken its function of promoting the public communication of the information .To treat public digital library as a special subject and formulate laws, or take measures for public digital library such as expanding ＂fair use＇appropriately, establishing the sys- tem of statutory license and improving the system of collective administration of copyright to promote the development of public digital library.
