从英美实践来看我国参与国际法律事务的有效性问题 被引量:13

The Issue of China's Effective Participation for International Legal Affairs:A Perspective of Comparing with the Practices of Both UK and US

摘要 国家在参与国际法律规则的制定与形成过程中,应确保自身的参与是一种有效的参与,能够通过参与把本国利益融入相应国际法律规则之中。从中国参与联合国国际法委员会和国际法院的活动实践来看,与荚美国家的相关参与实践相比较,无论是在参与技术、参与时机还是最终的参与效果上,中国的表现均不理想。在今后参与国际法律事务的过程中,为保证自身参与的有效性,中国在参与技术、参与方式等方面都有必要加以改进和完善。 During the drafting and adopting process of international legal rules, in order to integrate their interests into the rules, the participating states should participate in the process effectively. Compared with the participating practices of both UK and US, China demonstrates its ineffectiveness in both the activities of International Law Commission and the activities of the International Court of Justice. In order to participating effectively, it is important for China to improve and enhance its participation performances.
