关于《深圳大学条例》立法的几点思考

Some Thoughts on Shenzhen University Regulations Legislation

《深圳大学条例》(以下简称《条例》)作为国内首部高校立法即将出台,《条例》的立法主体是深圳市人常委会,作为授权经济特区法规具有高位阶效力,可突破现有行政体制一些限制,厘清政府与高校权力关系,保障高校权利于法有据。但《条例》作为法治手段,在治理教育育人的特殊性上有其局限性,必须要充分认识,保证教育育人本质。

Shenzhen University Regulations （hereinafter referred to as The Regulations）, as the first universities law in China, will come out soon. The legislative body of The Regulations is Shenzhen People＇s Congress Standing Committee, which as authorized special economic zones law with high status can break through the existing administrative system limitations. Meanwhile The Regulations clarify the government and the power relations in colleges and universities, safeguard the rights of colleges and universities according to laws. But The Regulations as a law means also has its limitations on the management to the particularity of education. This point should also be fully understood to guarantee the education essence of talent cultivation.
