Further Discussion the Quality and Quantity in Law

法学里通常是从程序正义和实体正义的角度论述,文章尝试不同的切入点;由"质"和"量"这两个概念,检验法学和法律。主要的发现可以简单归纳如次:法律可以视为规则,而规则的性质就是工具。法律所要处理的问题,可以由"质"和"量"的角度着眼。本文提出处理"质"和"量"的"三部曲",是对法律条文内容的描述,也提供了设计法律的参考指标。三部曲的结构,可以由成本效益的角度,提出合情合理的解读。

While legal scholars often examine issues from the perspective of procedural justice and substantive justice,the present article attempts to employ the concepts of'quality'and'quantity'to study legal issues.The main findings can be summarized as follows:law can be viewed as rules,and rules can be viewed as tools.Legal issues can often be analyzed fruitfully from the perspective of'quality'and 'quantity'.The article has put forward the 'three-step structure'to clarify the relationship between 'quality'and 'quantity'.It provides a description of the law and suggests a benchmark for law making.Furthermore,the 'three-step structure'can be explained by the costbenefit analysis.
