摘要
近年来,国内医患矛盾激化,伤医事件频发,使得医师成为"高危"职业。为维护医师的权益,法律界和伦理学界对于医师"拒诊权"的讨论已经甚嚣尘上。医师有不得拒绝诊疗的义务,但是拒绝对患者实施诊疗服务必然有其深层的原因。本文立足于法律和伦理层面,指出医师"拒诊权"存在的问题,并对如何完善相关法律规定及现实操作进行思考,以达到改善医患关系、减少医疗纠纷的目的。
Doctor is currently a ＂ high- risk＂ profession due to fierce doctor- patient conflicts and frequent incidents of hurting the doctors. In legal and ethical circles,doctors＇ right of ＂ refusal of diagnosis and treatment＂ is hotly discussed in order to protect doctors＇ rights and interests. It＇s the doctors＇ obligation not to refuse to diagnose and treat the patients. Yet there must exist deeper causes of such behaviors. Based on laws and ethics, this essay tries to point out the existing problems of doctors＇ refusal of diagnosis and treatment. Furthermore,in order to improve doctor- patient relationship and reduce medial disputes,this essay also reflects on how to perfect related laws and regulations and practical applications.
