Consequential Evaluation of Judicial Decision

不论是从经验层面来看,还是从规范层面来看,司法过程中的后果衡量都是存在的。后果衡量的后果是一种包括政治、经济、社会、文化、道德、正义、先例等一系列后果的综合性后果,但是由于理性的有限,司法过程中的后果衡量往往只选择一种具有凸显性的单一性后果来进行权衡。使得某种单一性后果凸显出来的,不外乎外部环境因素和主体偏好因素。然而,这种建立在外部环境和主体偏好基础上的后果衡量虽然可能是对司法过程的真实解读,但是却不具有正当性。作为一种替代方案,麦考密克版本的后果衡量提出了可普遍化的理想,有望克服环境和偏好的随意性。

No matter from the empirical perspective or the normative perspective,consequential evaluation really exists in judicial process. The consequence of consequential evaluation is a kind of comprehensive consequence includes political consequence,economic consequence,social consequence,cultural consequence,moral consequence,justice consequence,precedent consequence and so on. However,the consequential evaluation in judicial process often only selects one prominent consequence to weigh because of the limitation of rationality. What make the consequence to be prominent are nothing more than external environmental factors and internal personal preference. Although the consequential evaluation based on external environmental factors and internal personal preference may be the true interpretation to the judicial process,it is illegal. As an alternative scheme,Mc Cormick suggests that consequential evaluation in judicial process should be generalized,which is expected to overcome the arbitrariness of environment and preference.
