精神障碍患者非自愿医疗的法律问题研究(上)

精神障碍患者非自愿医疗是涉及到人权、社会安全等诸多方面的一个严重社会问题。"应被医疗而未被医疗,不应医疗却被医疗"的混乱局面,不仅侵犯了精神障碍患者的合法权益,而且对健康公民的权利也形成了严重威胁。历经27年后出台的《精神卫生法》亮点颇多,但这部千呼万唤的法律也存在着一些立法缺陷,例如非自愿医疗的程序规范力度不够、精神障碍患者与监护人利益冲突悬而未决等问题。本文旨在通过比较分析,为妥善解决我国现有制度中存在的问题提出建议。

Involuntary medical treatment of patients with mental disorder is related to a important social problem of human rights,social security and many other aspects.Chaos of ＂ Should be treated but not be treated,should not be treated but be treated＂,not only violates the legitimate rights and interests of？patients with mental disorder,but also to the right of healthy citizens.There are many highlights in the Mental Health Law.But this law also exists some defects in legislation.This paper aims to compare and analysis in order to properly solve the existing problems in the system.
