Walking between Liberty and Order——To Build the Axis of Practical Operation of the Public Order

"治安秩序何以可能"是治安学的核心议题。在与社会秩序的系统比较中探索厘清治安秩序概念,提出从"静秩序"走向"动秩序",转变单一治安思维,强调个体自由与社会秩序的协调统一。从"农业社会"到"工业社会",再到以个体化和碎片化为特征的"信息社会",转型期的治安秩序失调困境呈现出不断升级、日益复杂的趋势,对社会安全稳定造成严重威胁。建议代表个体自由的生活生产方式与代表社会秩序的自然人文系统相互形塑,构建具有矛盾性、动态性和实践性特征的治安实践运作"中轴",以"适度控制"为实践原则,保障良性治安秩序的实现。

The core issue of the public order subject is to seek the possibility of build the public order. Contrasting the public order and the social order, this paper systematically clarifies the concept of public order, promotes the move from static order to dynamic order, transforms the single pattern of thinking, and emphasizes the coordination and integration of individual freedom and social order. Developing from the a- gricuhural society to the industrial society, now the human world has developed to the information society. However, the conflicts between the value of freedom and order tend to be worse and complicated, which se- riously threatens the public order. This paper suggests that both sides shapes between the living and pro- ducing pattern representing the individual freedom and the natural and cultural system representing the so- cial order, that it establishes an practical operation axis of the public order with the characteristics of con- tradiction, dynamism and practicality, and finally practices under the principle of moderate control. Only with these ways listed can we guarantee the realization of a good public order.
