摘要
不动产物权登记生效制度在执意谋取一种制度价值的同时,也给该制度的实践造成了诸多困境:在中国大陆有诸如未经办理登记不动产物权的归属和保护问题;在中国台湾地区有诸如违章建筑买卖的所有权移转问题等。对此,学说和判例现有的解决之道是,以维护法的安定性为前提,在不动产物权登记生效制度之外寻找司法依据。难圆其说的现有理论,要求我们寻找新的问题解决之道:以法的适用的妥当性为目的,对公示制度以及公示生效制度进行璞真的认知,以此作为解决不动产登记生效制度在实践中困境的新出路。
Some difficulty is brought about while some value is figured for in registration effectiveness practice of real property right,for example:the problem of ownership and protection on the non-registered real property right in Chinese Mainland,and the question of ownership transfer on buying and selling of unauthorized construction in Taiwan.The way from the law theory and the judicial precedent is to look for the judicial basis out of the real property registration effectiveness,and on the premise of stability of law.The poor theory demands us to find new way that is aiming at the appropriateness of law to reexamine the public system and registration effectiveness.
