RBR司法模式乃"执果索因"司法模式之简称,它具有各种科学上的深层依据,在实践中有其发生的必然性。该模式在中外司法史上都不同程度地存在过,同时也引起学者们的广泛关注,赞成或异议者皆有之。在有关该模式的描述或争论中,无论是发现者、倡议者还是异议者,并没有清楚说明该模式生效的条件、作用的方式和功能的边界等基础性方法论特征。值得指出的是,该模式在中外方法论史上具有重要的地位或价值,并且也给予中外方法论学者以若干重要的启示。在对该模式的方法论特征和地位给予细致梳理的基础上,可以"假说—检验法"重构之,以克服其在知识谱系上的若干负面影响。

＂RBR judicial mode＂is＂Reason by Result judicial model＂for short.It has all kinds of deep scientific basis,and has its inevitability in practice.The model existed to varying degrees in the Chinese and foreign legal history,meanwhile attracting extensive attention of scholars,in favor or dissent.No matter discoverers,advocates and dissidents,they didn＇t clearly explain the basic methodology features of the model in the descriptions or debate such as the conditions of effect,the modes of role and the boundaries of function.It is worth pointing out that the model has an important status and value in both the Chinese and foreign history of methodology,and it also gives some important enlightenment to Chinese and foreign scholars of methodology.On the basis of detailed combing the methodology characteristics and status of the model,we can reconstruct it by＂hypothesis-test method＂,in order to overcome its negative impact on knowledge pedigree.
